We at AEON Wallet, a mobile money platform by AEON Specialized Bank (Cambodia) Plc., are committed towards protecting privacy of our customers using policies regarding the collection, usage and disclosure of the information provided by the customer.

Personally identifiable information includes all information to identify an individual user.

  1. Information Collection

Upon registering wallet yourself as an Unverified User, and/or to access services, you will only need to provide your mobile number, full name, gender and date of birth.

If you are being enrolled as a Verified User, you will need to provide your personal information. Personal information includes your mobile number, first name, last name, gender, date of birth, nationality, city, district, legal identification type, ID/Passport Number, valid till, and email address.

Aeon Wallet collect, store, process following types of sensitive personal information such as password, and physiological information for providing our products, services via mobile phone.

We may also hold information related to your utilization of our services by the use of our mobile app which may include following:

A. User Camera/ Gallery Photo

This information is used to obtain a locally stored image of the logged in user to be set as Profile Picture within app. None of the profile image is transferred via internet or collected by the server.

B. Network State and Internet Access

The application connects to a dedicated API to complete transactions services provided within. It uses these permissions to check if there is any connection to internet as well as to connect to the internet if not connected.

C. Read Contacts

The application accesses user’s phone contacts to select a contact so that the phone number of contact could be populated in the Aeon Wallet app using which user can choose to recharge airtime balance instead of having to manually type phone number, and transfer fund to member and non aeon wallet member.

D. User SMS

The application is able to send and received SMS through user’s device to forward transaction request and confirm transaction status respectively whenever there is no internet available. The user bears sent SMS charge based on the tariff of network provider. Receiving SMS is however free of cost to the user.

E. Precise Location Permission (Non-Continuous)

Certain feature like Agent locator requires access to location service to display nearby agents in the map, recommend to display the merchant promotion as per nearby merchants.

  1. Information Usage

The information that we collect from you are used in order to:

  • Verify your identity
  • Complete transaction effectively as per your request
  • Communicate about changes to our services
  • Respond to your queries in relation to service or assistance
  • Protect from unauthorized use of the wallet
  • Promote and market our products and services which we think could be of interest to you and may benefit you.
  • Safeguard against fraud, money laundering, and misuse of account by incorporating necessary identity verification
  1. Disclosure of Information

Your information will be kept confidential and will not be disclosed to other party except required by regulator and/or you agree for the disclosure.

We may keep a log of the activities performed by you and websites by using various internet techniques such as web cookies, server log files, etc. for analytical purposes and for analysis of the amiability of various features on our site. This information may be used to provide you with a better experience with our platform along with evidentiary purposes.

In case you do not provide your information or consent for usage of personal information or later on withdraw your consent for usage of the personal information so collected, Aeon Wallet reserves the right to not provide the services or to withdraw the services for which the said information was sought.

  1. Updates and Changes to Privacy Policy

Our Privacy Policy may change from time to time. Any changes on our privacy policy will be revised and the updated date will be posted at the bottom of this page. However, if there is significant change in the policy, we will provide a more prominent notice through SMS, push notifications, email etc. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications time and again.

The Use and Setting of Personal Privacy Notice Information or Data

This Privacy Notice (“Notice”) sets out the basis which AEON Specialized Bank (Cambodia) Plc. (“we”, “us”, or “our”) may collect, use, disclose or otherwise process CUSTOMER’s (“you”, or “your”) personal data in accordance with our internal data protection policy. This Notice applies to personal data we collect from you when you use our Application Form, Mobile Application, Website, or other products/services.

1. What information we collect:

  • We may collect information only when you provide it to us by registering/filling out any of our Application Form, Mobile Application,​Website, or other products/services. That information can be Name, Gender, Date of Birth, Nº. ID. Card/Family Book/Passport, Address, Marital Status, Phone, Email, Occupation, and so on.
  • You hereby agree and authorize the Bank to collect your information to input in ASB system under monitoring by National Bank of Cambodia. All collected information might be used for internal data base.

2. Your rights:

The rights you have regarding the information that stored including:

  • The right to request us to update your information if it is incorrect or incomplete from AEON Wallet Customer App. Upon assessment of the Bank, your updated information will be reflected in the App.
  • If you have doubt on our Products, Services, or our staff’s attitude, you have enough right to provide information to us via our Hotline: 023 988 555, 070 988 555, 078 988 555, Feedback Box in our branches or other ways per our advertisement.

3. We may collect and disclose your personal data to:

  • Those who provide banking services to assist and execute their functions or business activities.
  • Those who provide various insurance services or are considered to have provided insurance services.
  • Banker to assess the bank’s ability to repay if needed.
  • Employers and/or other stakeholders to specify job, activity, occupation, and income.
  • Those required by law to disclose and report.

Introduction

Before using AEON WALLET CAMBODIA’s App, please ensure you have carefully read and agreed to its terms and conditions. In case of any doubts, please contact AEON Specialized Bank (Cambodia) Plc. (“ASB”) for clear clarification at 023 988 555, 078 988 555, 070 988 555.

These terms and conditions also may serve as an agreement between you and ASB which means they apply to the subscription of your AEON WALLET CAMBODIA’s App and other related products and services available through its Merchants or Partners. If you do not agree to any of these, please stop using the App.

Only after accepting all terms and conditions contained herein you can effectively become a user of AEON WALLET CAMBODIA. ASB strongly recommends that you read other information on the other pages on website while reading these terms and conditions as they may contain other facts that may apply to your AEON WALLET CAMBODIA subscription.

1) Definition

  • ASB : AEON Specialized Bank (Cambodia) Plc.
  • Account : account of AEON WALLET CAMBODIA Application under ASB.
  • Application or App : AEON WALLET CAMBODIA smartphone application.
  • Working Day : Monday to Friday, 09:00AM to 06:00PM excluding weekend and public holiday.
  • Customer Services : service team that shall handle and process your enquiries relating to usage of AEON WALLET CAMBODIA.
  • Fee : any fees that may charge by ASB and which are stated in AEON WALLET CAMBODIA App.
  • Information : any ​account information that you provided to ASB including personal information, financial information or other information related to you or your business but not limited to payment process, stores or other features of ASB Service.
  • Merchant : a user who is selling goods and/or services and using the AEON WALLET CAMBODIA to receive payments.
  • Product : any merchandise, goods or service that a buyer may purchase using a AEON WALLET CAMBODIA.
  • PIN : a 4 digit secret number you use to access and conduct operation to AEON WALLET CAMBODIA App in your smartphone.
  • QR-Code : a quick respond code that contains merchant information and merchant ID and readable by smartphone to make payment at merchant.
  • Transaction : any crediting or debiting action made from a AEON WALLET CAMBODIA user.
  • You : Account holder or the person who registers account in AEON WALLET CAMBODIA App.
  • Eligible Transaction : any payment transaction made by Merchant through AEON WALLET CAMBODIA App.
  • EDC : means the electronic data capture which is the electronic device used to process AEON Wallet payments.
  • AEON Wallet Account : means the Wallet account that a Customer open with AEON Wallet to access ASB Services.

2) What is AEON WALLET CAMBODIA?

AEON Wallet is payment wallet that introduced by ASB. It is either pay to merchant, pay bill, phone top up and transfer fund within ASB Networks by using smartphone or feature phone. This is a prepaid account and purely transaction with Khmer Riel currency.

3) Eligibility

  • Be age under 18 is required consent letter from parents;
  • Be age equal or over 18 is required NID or Passport; and
  • Have a compatible phone that is operated by iOS or Android or others equivalent device.

4) Service Availability and Restriction

In order to use the service, you must register for an account. You may only hold one account. The service is only available to individuals or businesses that can form legally binding contracts under applicable laws. Without limiting the foregoing, service is not available to persons who are suspended from ASB services or to persons who present an unacceptable level of credit risk.

You are authorized to use functions in AEON WALLET CAMBODIA as below:

  • Register Account,
  • Cash in and Cash out,
  • Send Money,
  • Check Balance,
  • Check Transaction History,
  • Billing Payment,
  • Mobile Top up,
  • Reward Point Inquiry,
  • Make Payment to Purchase Goods and Services;

You must not use AEON WALLET CAMBODIA App for any of the following purposes:

a) Anything unlawful or illegal or which is fraudulent or malicious or which promotes any criminal activity;

b) Anything which is defamatory, harassing or threatening or which otherwise infringes or violates the rights of others. This includes any information that you may add or upload to AEON WALLET CAMBODIA App;

c) Interfering in any way with any other user of AEON WALLET CAMBODIA App; and/or

d) Knowingly introducing viruses or other malicious or harmful material or using it in connection with unsolicited communications.

You must not use AEON WALLET CAMBODIA App in a way that may damage or impair the App, the service or ASB underlying systems and security.

As the App facilitates security is most importance, you must keep your device secure and properly close the App after each use. You must ensure that any security details, and account information and all other information that you provide to ASB via the App or any other channels is complete, accurate and up to date.

5) AEON Wallet Rewards Terms and Conditions

Issuing of AEON Wallet Rewards

AEON Wallet Rewards is typically accorded to Customers at ASB’s discretion when he or she make a payment transaction using the AEON Wallet application. AEON Wallet Rewards is issued for loyalty, award or promotional purposes.

AEON Wallet Rewards may be issued within the AEON Wallet application, which registered their personal details on the AEON Wallet application and/or log in into the app by customer (collectively referred to as “AEON Wallet App”).

The total amount of AEON Wallet Rewards accorded shall be determined by ASB in its sole and absolute discretion. In determining such value, ASB may consider criteria including but not limited to a Customer’s transaction history on the AEON Wallet App.

AEON Wallet Rewards Use and Redemption

AEON Wallet Rewards is not legal tender, has no cash value and is not redeemable for cash. AEON Wallet Rewards also cannot be transferred, resold or exchanged for cash.

Please note that although AEON Wallet Rewards is described as being equivalent to certain currencies (e.g. KHR), such description is purely for the Customer’s convenience. The currency amount is merely to provide an “indicative value” of what may be redeemed with AEON Wallet Rewards. The respective AEON Wallet Rewards values are not pegged to the actual cash value and the “indicative value” is subject to change at the discretion of ASB.

ASB shall not be held liable for any variances resulting from payments that are paid with AEON Wallet Rewards. ASB may cancel or amend the value of AEON Wallet Rewards at its discretion and Customers have no claim against ASB for the “indicative value” or for any other moneys.

AEON Wallet Rewards can be earned from eligible transactions which are listed in these terms and conditions and redeemed only through AEON Wallet App, as amended from time to time. Accumulation of AEON Wallet Rewards does not entitle the Customer to any vested rights with respect to any promotion, offer, campaign or the Program, except for the opportunity to surrender them for redemption in accordance with these terms and conditions.

ASB may impose a minimum balance payment from the financial wallet for each transaction including AEON Wallet Rewards redemption. When redeeming AEON Wallet Rewards during a payment transaction, Customers have to redeem AEON Wallet Rewards with a combination of financial wallet. No full redemption of AEON Wallet Rewards is allowed for payment transaction. The balance of unredeemed AEON Wallet Rewards can be checked and accessed at any time by the Customer on the AEON Wallet App.

Refunds for AEON Wallet Rewards due to disputable transactions are only applicable if the merchant accepts to proceed the refund transaction.

Validity and Expiration of AEON Wallet Rewards

AEON Wallet Rewards will have 24 months’ validity period from the date of issuance, unless terminated by ASB in accordance with these terms and conditions.

Customer shall not be able to use AEON Wallet Rewards on and from the expiry date specified or upon earlier termination of the AEON Wallet Rewards in accordance with these terms and conditions.

Any unredeemed AEON Wallet Rewards as of the expiry or termination date will be rendered void and thereafter cannot be redeemed or reused by a user.

AEON Wallet Rewards is not transferrable to another AEON Wallet Account or a new account open by the same Customer.

Modifications, Restrictions, Terminations etc.

AEON Wallet Rewards, the Program and its benefits are offered at the discretion of ASB who has the right to terminate the Program or to change the Program rules, these terms and conditions, benefits, conditions of participation or AEON Wallet Rewards limits, in whole or in part, at any time, with notice refer to clause 9 even though changes may affect the ability to redeem any AEON Wallet Rewards already granted.

ASB may, among other things, withdraw, limit, modify or cancel any special offers; increase or decrease the amount of AEON Wallet Rewards earned at a payment transaction; increase or decrease the amount of AEON Wallet Rewards required to redeem for value in the wallet; modify, suspend or regulate the transferability of AEON Wallet Rewards or benefits; add an unlimited number of blackout dates; or limit the number of Merchants or Eligible Transactions; or otherwise make changes to the Program at its discretion or as may be required by law or regulation with notice refer to clause 9.

Participation in the Program is subject to these terms and conditions set out herein and as ASB may, at its discretion, amend from time to time. ASB has the sole right to interpret and apply the Program in accordance with these terms and conditions. Any failure to follow the terms and conditions set out herein, any abuse of Program privileges, any conduct detrimental to the interests of ASB, or any misrepresentation of any information furnished to ASB or its affiliates by any participant in the Program, or anyone else acting on the participant’s behalf, may result in the termination of a user’s AEON Wallet Rewards or any other benefits, in whole or in part.

Indemnity

The Customer shall defend, indemnify and hold ASB and its affiliates harmless from any and all claims, liabilities, costs and expenses arising in any way from his or her participation in this Program or related to any violation of these terms and conditions by the Customer or authorised users of the Customer’s AEON Wallet account.

6) The Legal Relationship between you and ASB 

a) Identity Authentication: ASB use many techniques to identify its own customers when he or she registers on AEON WALLET CAMBODIA App. Please understand that verification of you is only an indication of increased likelihood that your identity is correct and having valid SIM which registered to AEON Wallet & active App is part of our verification method, otherwise ASB will not be able to accept cash withdrawal. You authorize AEON WALLET CAMBODIA, directly or through third parties to make any inquiries ASB consider necessary to validate your registration. However, because the verification process is difficult, ASB cannot and does not guarantee any of your identity.

b) Limitation of Liability: In no event shall ASB, ASB’s parent, subsidiaries, employees or ASB suppliers be liable for lost profits or any special, incidental or consequential damages (however arising including negligence).

c) Indemnification: You agree to indemnify and hold ASB, its parent, subsidiaries, affiliates, officers, directors and employees harmless from any claim or demand (including attorneys’ fees) made by you or incurred by any third party due to or arising out of your breach of this terms and conditions or the documents it incorporates by reference, or your violation of any laws or the rights of a third party relating to your use of the service or products.

d) Liability for Violations: If you engage in the following behaviour, ASB may fine you, as explained below:

  • Using the AEON WALLET CAMBODIA to make payments for any sexually oriented or obscene materials or services in violation of applicable laws in Cambodia.
  • Using the AEON WALLET CAMBODIA to make payments for any narcotics, other controlled substances, steroids or prescription drugs in violation of applicable laws in Cambodia.
  • Using the AEON WALLET CAMBODIA to make payments for wagers, gambling, regardless of the location or type of gambling activity.

e) Your PIN Responsibilities: You shall not set PIN as your smartphone number or date of birth, you shall not share Your PIN and your smartphone to anyone, you shall change PIN frequently, and You shall not write down or record PIN in any place example on smartphone, paper or card…etc;. ASB shall not be liable for lost and/or damage which occurs as the result of Your above mentioned faults.

You and ASB agree that the damages that ASB shall sustain as a result of the behaviour outlined above shall be substantial, including (without limitation) fines and other related expenses from its payment processors and service providers. In the event that you engage in such activities, then ASB may fine you as cash with any amount.

If you use AEON WALLET CAMBODIA in a manner that violates the terms and conditions including but not limited to the three categories described above, your account shall be subject to limitation or immediate block.

Without limiting the foregoing, you agree to reimburse ASB for any or all costs, expenses, and fines levied on ASB by its payment processors and/or service providers as a result of your activities. You agree that, if either you or ASB commences litigation or arbitration in connection with this paragraph, the prevailing party is entitled to recover reasonable attorneys’ fees and any other costs incurred in such proceeding in addition to any other relief to which the prevailing party may be entitled.

7) Payment Disputes

a) Any complaint which is not relating to payment services or not specific transaction (for example about the quality of any goods or service received from a Merchant), should be resolved directly with the relevant third party (Merchant).

b) ASB take complaints very seriously and value the opportunity you provide to assist with reviewing the way ASB do business and helping to meet customers’ expectations. ASB primary aim is to resolve any complaints that you may have as quickly and effectively as it can and consequently have documented in the ASB Complaint Handling Policy​.

8) Notices and Changes to Fees and Charges, Terms and Conditions

ASB may change these terms and conditions, fees and charges, and terms and conditions for the point program at any time. ASB will give you at least 30 (thirty) calendar days notice of any such change before it takes effect by:

  • notice displayed on ASB’s website at https://www.aeon.com.kh/ or by advertisement in major daily or national newspapers; or
  • contacting you on your mobile phone via SMS notification or electronic notices generated within the AEON Wallet menu system.

ASB may also use the methods outlined above as a means of providing you notices or other correspondences, or by contacting you in writing at your address recorded in ASB’s records.

9) Suspension or Termination of AEON WALLET CAMBODIA

a) By You

Shall you decide to terminate your use of the AEON WALLET CAMBODIA Service:

  • You shall visit ASB branch which operates AEON Wallet Service for closure request and follow the instructions for closure.
  • You understand that deletion of the AEON WALLET CAMBODIA App alone does not terminate the use of or close the AEON WALLET CAMBODIA If you delete the AEON WALLET CAMBODIA App without providing the necessary instructions to ASB as mentioned above, your account shall continue to be active in ASB. Upon expiry of such period if the AEON WALLET CAMBODIA Account remains non-operational, the AEON WALLET CAMBODIA account may suspend or terminate as per the policy of the ASB.
  • You shall not be entitled to any payment, compensation or damages from ASB in relation to the termination of your access to and use of the AEON WALLET CAMBODIA App and/or the AEON WALLET CAMBODIA Service.

b) By ASB

If there is a nil balance and/or point recorded on your AEON Wallet Account, via SMS notification and you have not made any monetary transaction by the AEON Wallet Payment Services for 365 days (12 consecutive months) then ASB may, at its sole discretion, suspend or terminate your access to AEON Wallet Payment Services and close your AEON Wallet Account.

If there is a balance and/or point recorded on your AEON Wallet Account, via SMS notification and you have not utilised the AEON Wallet Payment Services for 365 days (12 consecutive months), then ASB may, at its sole discretion, suspend or terminate your access to AEON Wallet Payment Services and asking for withdrawal all the remaining balance for closing your AEON Wallet Account.

ASB may also exercise its discretion to suspend or terminate your access to AEON Wallet Payment Services and close your AEON Wallet Account for whatever reason, and notify you via SMS including, but not limited to, unsatisfactory conduct or where required by law or for any other reason ASB considers appropriate.

In the event that ASB exercises its right contemplated in this clause, ASB will promptly inform and ASB shall not be responsible or liable for any loss which you may suffer as a result.

Notwithstanding Clause 8(b) above, ASB reserves the right, at their absolute discretion and at any time, to immediately suspend / terminate the use of AEON Wallet Account by Customer for any reason, including but not limited to the following circumstances:

  • In the opinion of ASB, a Customer has indulged in any dishonest, fraudulent, illegal and/or criminal conduct or misrepresentation;
  • The Customer is in breach of any of the provisions of the terms and conditions or has engaged in any conduct prejudicial to ASB;
  • The Customer is in breach of any acts, statutes, laws, by-laws, rules and / or regulations imposed by any party, regulatory body or government agency;
  • The Customer has submitted false documents or has declared false information during the application for the AEON Wallet Payment Services by the Customer;
  • The Customer has acted with bad or malicious intent; and / or
  • ASB is of the opinion that the act of the Customer is prejudicial to the interest of AEON Wallet.

c) What happens if Termination occurs

If your access to AEON Wallet Payment Services has been terminated (including as a result of the closure of your AEON Wallet Account), ASB will arrange payment of the balance of funds recorded on your AEON Wallet Account at the closing date to you at the address shown in its records with valid registered SIM /App and enable to conduct customer KYC. In the event that ASB is unable to contact you at your address shown in its records to arrange payment, ASB will follow Circular on Requirements for Bank and Financial Institutions to have a System of Checks and Balances dated 25 January 2005 and Article 71 of the Law on Banking and Financial Institutions.

10) Interest and Fee charge

The AEON WALLET CAMBODIA account is prepaid account, not deposit or saving account. Hence, ASB does not provide interest to you on cash​ deposit into your account.

You agreed to pay service fee to ASB in order to access transaction such as fund transfer and cash withdrawal.

11) Governing Law

This terms and conditions shall be governed by and construed in accordance with the laws of Cambodia.
