Welcome and thank you for choosing to use AEON 3D Secure Service (hereinafter called “AEON 3Ds”). Before using AEON 3Ds, please thoroughly read the Terms and Conditions (hereinafter called “T&C”) carefully. In the event that you are disagreeable and reject to the T&C specified hereunder, please STOP the transaction. The T&C of AEON 3Ds shall be deemed as supplementary Terms and Conditions to and as an integral part of AEON Credit Card agreement. Therefore, in addition to the T&C hereof, any transaction transacted by you through AEON 3Ds is also subjected to the relevant AEON Credit Card agreement only to the extent not being contrary to the T&C hereof. The words “we”, “us” and “our” referred herein AEON Specialized Bank (Cambodia) Plc. and “you,” “your,” or “yours” referred herein shall mean AEON Cardholder, the AEON Cardholder it is either primary or supplementary, and either AEON Gold Card or AEON Violet Card, (hereinafter called “AEON Card”).

1. Participation

All AEON Cardholders, either new or existing, shall be required to participate in AEON 3Ds automatically. Your participation in this AEON 3Ds shall keep continue as long as you are AEON Cardholder even you have been used this service or not.

2. Acceptance of Terms and Conditions

a) AEON 3Ds provides its service to you, subject to the following T&C and the AEON Credit Card agreement governing any transaction transacted by you through AEON 3Ds only to the extent not being contrary to the T&C. The T&C is always subjected to revision and/or change and/or alteration and/or amendment, and/or update by us from time to time without prior notice to you. In addition, when using AEON 3Ds, you shall be subjected to any guidelines or rules determined by Visa International (Asia-Pacific) Ltd. and also applicable to AEON 3Ds that may be posted from time to time on the website of Visa International (Asia-Pacific) Ltd.

b) You agree that a determination of AEON 3Ds used will represent your acceptance of this T&C, and your continuing use of AEON 3Ds after revisions and/or change and/or alteration and/or amendment and/or update to this T&C.

c) Unless otherwise explicitly stated herein, any new features of AEON 3Ds that may constitute any augment, enhancement or otherwise change to AEON 3Ds shall be subjected to this T&C. Such augment, enhancement or change to AEON 3Ds shall not impair this T&C and this T&C shall be still effective.

d) We reserve the right at any time and from time to time; to modify, suspend or discontinue, whether temporarily or permanently, providing AEON 3Ds without prior notice.

3. AEON 3Ds Description

AEON 3Ds provides you a way of increasing security by minimizing the chances of fraudulent online transactions which using the One-Time Password (as known as OTP) to complete the transaction. In registration for AEON Card, you are required to provide your personal information to us, which is then used to confirm your identity in connection with your online transactions and/or other transactions transacted by you through AEON 3Ds, as discussed in more detail in Section 6 below. AEON 3Ds may be used for any relevant recording, keeping and reporting purposes, as well as resolving any transaction disputes. Your information registration, as defined in Section 5, and other personal information shall not be shared with any merchants, as described in more detail in Section 8 below.

4. AEON 3Ds Card Brand Acceptance

AEON 3Ds processes through Visa Secure for VISA card. You may identify the 3D secure merchant by Visa Secure acceptance sign on the merchant payment web page.

5. Your Information Data Provision Obligation

You agree to provide us for true, accurate, current and complete information about yourself and fill in such information on AEON Card registration form (as your declaration and agreement) and always maintain, from time to time update your information in order to enable us to keep your information as true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to suspect that your information is untrue, inaccurate, not current or incomplete, we have the right to suspend, terminate, or refuse your current or future use of AEON 3Ds and/or your AEON Card account. You hereby agree and accept that such suspension, termination, or refuse by us to your current or future use of AEON 3Ds or your AEON Card account shall not cause any responsibilities and/or liabilities against us and you shall not raise such suspension, termination, or refuse to be a cause of your loss and/or damage.

6. Authentication

a) During registration for AEON Card, you may be asked to ensure the phone number and email to receive the OTP. When engaging in an online transaction or other form of transaction on 3D secure merchant for which AEON 3Ds is used, you may be asked to enter the OTP which has been sent to your registered phone number and email to complete your transaction on merchant payment checkout. If you are unable to enter the OTP the merchant may not accept your payment for that transaction. Therefore, you are obliged to inform us of any change regarding your phone number and email.

b) By using AEON 3Ds, you agree to the use and the method of AEON 3Ds to evidence your authenticated identity and hereby certify the completed transactions authorized and approved to transact through AEON 3Ds.

7. Your OTP Security Measure

You are solely responsible for maintaining the confidentiality of your phone number and email which have been registered to receive OTP and other verification information established by you with AEON 3Ds. You agree to immediately notify us of any unauthorized used or lost/stolen your AEON Card, or any other violation of security measure that you identified such as your phone pop up message alert of any online shopping. You acknowledge and agree that, except as otherwise provided by applicable law or in the AEON Cardholder declaration and agreement, we shall not be liable for any loss and/or damage arising from your failure to comply with this T&C.

8. Privacy of Your Information Data

a) We shall store your information data provided for AEON 3Ds. Your information data shall not be shared with and shall not be disclosed to any online retail merchants or any other type of merchants which AEON 3Ds is used for verification of transactions.

b) You acknowledge and agree that your information data provided for AEON 3Ds may be disclosed by us:

1. Only to the extent required by applicable laws and/or by applicable regulations and/or orders of any regulatory authorities and/or the National Bank of Cambodia; or
2. As reasonably necessary for us to enforce this T&C. You hereby agree and accept that such disclosure by us shall not cause any responsibilities and/or liabilities on our part.

9. Your Conduct

You agree not to:

a) impersonate any person or entity for using AEON 3Ds.

b) upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer, hardware, software or other telecommunications equipment using AEON 3Ds.

c) modify, adapt, translate, decompile or disassemble any portion of the authentication page or the software used in connection with AEON 3Ds.

d) remove any copyright, trademark, or other proprietary rights notices contained in AEON 3Ds authentication page.

e) otherwise interfere with, or disrupt, AEON 3Ds or servers or networks connected to AEON 3Ds, or violate this T&C or any requirements, policies of AEON 3Ds or of any networks connected to AEON 3Ds.

f) intentionally or unintentionally violate any applicable local, state, national or international statute, regulation, regulatory guideline or judicial or administrative interpretation, or any rule or requirement established by Visa (all of which shall constitute “Applicable Regulation”) in connection with your use of AEON 3Ds.

g) any other activities to damage the AEON 3Ds authentication page.

10. Liabilities

It is understood that we shall be liable for consequential, incidental, special or indirect losses or other damage, such as any damage to your computer or telephone service resulting from your use of AEON 3Ds.  BUT, we assume no responsibility and shall not be liable for any damage to, or any viruses which may affect, your computer equipment or other property on AEON Card account of your access to, use of, or downloading from merchant payment web.

11. Your Dealing with Merchant

Your correspondence or business dealings with, or participation in promotions of, online retail merchants or other type of merchants where business dealing transacted on or through AEON 3Ds, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such business dealings, are the matter solely bound between you and such relevant merchant. You agree that, except as otherwise provided by applicable laws or in our AEON Card agreement with you, we shall not be responsible or liable for any loss or damage of any sort of loss or damage incurred as the result of any such business dealings. You understand that use of AEON 3Ds does not, in any way, indicate that we recommend or endorse any merchant, regardless of whether or not such merchant participates in AEON 3Ds. For example, AEON 3Ds does not verify the identity of the merchant or the quality of the merchant’s goods or services, etc.

12. Disclaimer of Warranties

a) You expressly understand and agree that any software obtained through the use of AEON 3Ds is used at your own discretion and risk; and that except as otherwise provided in this T&C, you shall be solely responsible for any damage incurred to your computer system or loss of data that results from the download or use of any such software or other materials through AEON 3Ds.

b) Except as otherwise required by any applicable law, we make no representations or warranties about AEON 3Ds of any kind, express or implied, including any warranties as to merchant ability or fitness for a particular purpose.
